David Robert Fishburn, 32, arrested on suspicion of DUI after his role in a crash that left scooter driver Jacobie Lee Harrell, 26, in critical condition in Sarasota, Florida

Scooter, vehicle collision sends Sarasota man to hospital

According to a Florida Highway Patrol report Fishburn was traveling north on Higel in his 2014 Acura MDX when he attempted to pass Harrell's 2011 TAO Scooter. Fishburn's vehicle sideswiped the scooter and the 26-year-old Harrell was ejected onto the roadway.Due to the size of the scooter Fishburn was unaware he had hit it. Harrell, who was not wearing a helmet, fell underneath the right rear tire of the Acura.

Harrell was airlifted to Blake Medical Center in Bradenton just after 2 am. after the incident, which occurred near the intersection of Higel Ave. and Cedar Park Circle. Fishburn was not injured, and he is facing one count of DUI with bodily injury and one count of DUI with property damage.
