An Emeryville man was charged with murder Thursday for a crash in Fremont early Tuesday morning that killed 23-year-old Andrew Silva of Union City, a U.S. Marine who had recently returned from a tour of duty in Afghanistan.

The family of a U.S. Marine killed in a vehicle accident is suing the city and police, blaming an officer for chasing an allegedly drunken driver who struck the war veteran as he rode a motorcycle.
Police were investigating a fatal DUI crash between a vehicle and a motorcyclist in Fremont Tuesday morning. Officers responded to the collision on Fremont Boulevard and Decoto Road, police said. The motorcyclist, later identified as Andrew Silva, 23, a U.S. Marine, was pronounced dead at the scene, according to police. Alcohol appears to be factor in the crash and the driver of the vehicle, identified by police as 23-year-old Alexander Yohn of Emeryville, was arrested. It all began when employees at a nearby Taco Bell called police to report a “drunk, belligerent” driver who came through the drive thru, police spokeswoman Geneva Bosques said. “He left Taco Bell, proceeded northbound on Fremont Boulevard and eventually hit the motorcycle at the end of the intersection at Decoto,” she said. “He continued on, crashed into a utility pole, the car actually caught on fire when he fled his vehicle” Bosques said that prior to the collision a police did try to pull over the driver but the officer said he “failed to yield” and that it was never a police pursuit. The intersection will be closed to traffic until at least 12 p.m., Bosques said.
