The SUV was caught on the tracks with no way to escape. "It appears that the vehicle that was struck today was trapped in traffic. It was stuck there prior to the railroad arms going down and was unable to get off the tracks safely before it was impacted at a high rate of speed by the Amtrak train," San Leandro Police Department Lt. Bob McManus said.

Roadwork cones marked the area along Washington Avenue on Tuesday, and there was congestion where Vanessa Henriquez stopped her Toyota RAV-4 on the railroad tracks just moments before the train barreled into the vehicle, killing her and her 3-year-old daughter Saidy.
Why every fatality from a crash is not legally a wrongful death
After someone dies in a motor-vehicle accident, grieving family members and friends are often left with many questions. What caused the accident? Could it have been avoided? What do they do now that their loved one is gone?
Sometimes a fatal collision happens through no one's fault. Crashes caused by weather and road conditions, or by wildlife in the roadway, are examples. But when a fatal crash is caused by negligence, then family members should pursue a wrongful death claim, to uphold the victim's rights and begin the financial recovery process.
