According to CSP, excessive speed and alcohol or drug use are not believed to have been factors in the crash. CSP said seat belts were likely not in use during the crash.

A 2004 Chevrolet Malibu driven by Matthew Rusher was going westbound on Otero County Road 811 when Rusher failed to negotiate a curve and went off the left side of the road and rolled, ejecting Rusher.
