Greis was legally intoxicated with a blood-alcohol level between .082 and .092 and had admitted to police he consumed alcohol and marijuana that day, the arrest warrant stated.
Daniel Gries was under the influence and driving on the wrong side of Staffordsburg road when he hit an oncoming vehicle, authorities say.
Commonwealth attorney Rob Sanders said Greis was legally intoxicated at the time of the crash and admitted to consuming marijuana. In court, officers said Greis was going 96 miles per hour.
It's a possibility Greis spends the rest of his life in prison, he said. Each charge of wanton murder can bring a prison sentence of 20 years minimum up to 50 years maximum.
Prosecutors say Daniel Greis was driving under the influence before a crash that killed a family of five in October. On Monday, a Kenton County judge set his trial date for June 19.
Last week, Kenton County Judge Patricia Summe granted a defense motion to suppress any statements made by Greis to Kenton County Sheriff's Deputy Curtis Bush while at University of Cincinnati Medical Center Oct. 26, the night of the crash.
Gries said he tried to pass Phillips but the other driver would speed up when he tried to pass and slowed down afterward. Greis said he floored his car to try to beat the truck as they approached a hill. Next thing he knew, he woke up in a field.
After a four-hour deliberation, a Kenton County jury has found 58-year-old Daniel Edward Greis guilty of five counts of wanton murder in the deaths of an Independence family in an October crash.
