A man accused of driving drunk and crashing into a Billings police car Tuesday morning made an initial court appearance Wednesday. Brett Allen Jones, 29, appeared in Yellowstone County Justice Court on charges of felony criminal endangerment and a misdemeanor count of DUI, or an alternate misdemeanor charge of operating a vehicle with a blood alcohol level greater than .08 percent. Judge Pedro R. Hernandez set bond at $10,000 and ordered Jones to appeared for arraignment in Yellowstone County District Court on May 2. According to charging documents, a Billings police officer reported at 7:47 Tuesday he had been in an accident at the intersection of Eighth Street West and Miles Avenue. The officer sounded like he was in pain and requested medical attention, an affidavit states. Other officers responded and found the policeman tending to Jones, who was identified as the driver of the other vehicle involved in the crash. Both vehicles had front-end damage. The officer and Jones were checked for injuries and neither was taken to a hospital. The officer, who had been driving north on Eighth Street West, reported that Jones had been driving west on Miles Avenue and failed to yield at the intersection. Officers reported that Jones smelled of alcohol. An initial breath test revealed he had a blood alcohol content of .097, which is above the legal limit of .08, charging documents state. Jones told an officer he was on his way to work and had consumed some beer before going to bed Monday night. Jones told the officer he thought the beer had “impaired his ability to see and judge distance,” according to charging documents.
