Michael Casey Holland had been part of a crew installing a sewage line at a home near Southwest Multnomah Boulevard and 54th Avenue. He was inside the 11-foot deep trench but outside of the safety zone when it caved in.

This is a worker compensation
This is a worker compensation claim because the accident happened while Michael was working for his employer. The worker compensation law provides benefits to Michael's spouse and children. Each will received a portion of his monthy salary. The children will receive monthy payment until each reaches the age of 18. The spouse will receive benefits until she remarries. In addition under certain circumstances Michael domestic partner may also qualify for benefits and any children born to them. In additon there may be a claim under the Employer Liabilitiy Law of Oregon for dangerous employments. The ELL is a direct law suit against the employer and provides an additional remedy to the Worker Compensation remedy. A claim should be made with Michael employer immediately.
