Man arrested for intoxication manslaughter in crash

Nicole Robinson, 37, was also arrested and charged with DWI. Police said she was not involved in the crash, but was following Gee in another vehicle.

Despite legal breath test, man charged with intoxication manslaughter

The officer on the scene said he could smell alcohol on Gee’s breath and felt Gee was intoxicated based on the results of the Standardized Field Sobriety Test. Even though the Portable Breathalyzer Test returned a .07 blood alcohol level result, below the .08 legal limit, the officer felt based on the totality of the circumstances there was enough probable cause to charge Gee with intoxication manslaughter.
Two people face charges after a fatal collision in East Austin early Thursday morning.  Robert Gregory Hanks, 58, was killed in the crash which happened at Berkman Drive and Cloverleaf Drive around 1:40 a.m. Thursday. A pickup truck was speeding east on Cloverleaf Drive, ran the stop sign, then crashed into a car traveling north on Berkman Drive. The car rolled off the road and on to the grass. Samuel Gee, 45, was the speeding driver on Cloverleaf Drive.Hanks, the driver of the car, was pronounced deceased at the crash site. Gee is in custody at the Travis County Jail and is charged with intoxication manslaughter. His bond is set at $50,000.

If a judge isn't DWI for less than .08 bac, with an open container, then this dude is also innocent of the manslaughter charge.
