One dead, one charged in crash near Buda

According to Texas Department of Public Safety Trooper Robbie Barrera, the two-vehicle crash happened around 8 p.m. Monday on FM 1626 just south of Buda. According to Barrera, 60-year-old Nancy Sterling-Dalton was driving northbound on FM 1626 when 37-year-old Jason Tarr, driving southbound, swerved into northbound traffic and crashed into Sterling-Dalton's car.

A 37-year-old man has been charged with intoxication manslaughter in connection with a Monday night crash in Hays County, a Department of Public Safety spokeswoman said.

One of the drivers involved in Monday night’s deadly crash along FM 1626 near Eagle Nest Drive is facing an intoxication manslaughter charge. The Hays County Sheriff’s Office tells KXAN that Jason Tarr faces the charge following the death of 60-year-old Nancy Sterling-Dalton.

A check of public records shows Tarr was previously arrested for DWI in 2002 in Hays County. He received two years probation and 80 hours of community service for that offense. Tarr’s criminal case records also indicate that was his second DWI arrest, but it is unclear at this time where his first DWI arrest took place.

Sec. 49.08. INTOXICATION MANSLAUGHTER. (a) A person commits an offense if the person: (1) operates a motor vehicle in a public place, operates an aircraft, a watercraft, or an amusement ride, or assembles a mobile amusement ride; and (2) is intoxicated and by reason of that intoxication causes the death of another by accident or mistake. (b) Except as provided by Section 49.09, an offense under this section is a felony of the second degree.

When KVUE asked DPS if Tarr was driving on a suspended license, a spokesperson said she didn't know, and that the information would be released in around 10 days after the crash report is made available.

A computer search by KVUE News found at least four prior DWI arrests for 37-year-old Tarr; however, it's unclear how many of those ended up in convictions. Tarr was arrested for DWI on Valentines Day 2001, Oct. 18, 2002, Oct. 5, 2003 and April 24, 2004.

Man who caused deadly Buda DWI crash will spend 20 years in prison

After less than 10 hours of deliberations, a Hays County jury has sentenced a man found guilty of murder and intoxication manslaughter to 20 years in prison.

Nancy Sterling-Dalton was pronounced dead at the scene, according to police. Jason Tarr was charged with intoxication manslaughter and was booked in the Hays County Jail.

Five (5) previous DWI Arrests..... really?

No, he had two other DWI's (over many years) not 5, and they are not sure now if he was legally drunk or not. He had just gotten off the golf course...so sad for everyone.

And nobody is getting drunk on the golf course these days.

It's more than sad...it's tragic for the family and friends of Nancy Sterling-Dalton, a wonderful person who happened to be in the path of an immoral moron.

According to arrest records he had 5 prior dwi charges!!!! How the heck was he even allowed on the street let alone driving with a Texas drivers license ??? He needs to be in prison!!!

Usually a DUI is obtained after the driver "didn't get caught" drinking & driving over long periods of time. I would speculate that drinking & driving was a regular behavior for this man, he just happened to get caught a few times, had a high paid lawyer & got off or reduced the penalty by spending lots & lots of money. This time no lawyer is gonna be able to help him, it'll be up to a jury of his peers to decide.

I want to know how a person with 4 prior DWI arrests is even allowed to drive again period and drunk as well and kill my good friend, Nancy Sterling-Dalton.

I just read that Jason Tarr has been released by paying a $150,000 bond! Where is the justice for the victim? This is not his first offense!

Jason will get his due process, no mistaking that. Prayers to the family of Nancy, and even to the family of Jason, they will also be affected by his actions.

Nancy is my cousin. Jason Tarr is an absolute piece of human excrement! Being CAUGHT five times driving drunk was not enough for this jerk? Two years probation and 80 hours of community service for his SECOND conviction? Whoever the judges were that he stood before and pleaded "no contest" or "not guilty" or pled to a lesser offense, they have blood on their hands, too. Jason Tarr should have been walking, riding a bicycle, or public transportation for the rest of his life. Instead, he takes my cousin's life and leaves her two children without their last living parent. You are a disgrace, Jason Tarr, and the final judgment will be the one that matters!

You are right...Jason Tarr is a subhuman slime, who had no right to ever drive again. However he managed to get around his previous crimes represents a travesty of law, and there must be others who helped him slither out of his responsibility for them whether by money or corruption. They all bear some responsibility for this tragedy, and they know who they are. What happened to the legal system here?

To the family of Nancy Sterling-Dalton:  The District Attorney did a great job in adding additional charges prior to this case going to trial. Something I had asked for in a case where my Son was killed and so many of us family and community members asked the “previous” DA for a Manslaughter charge and it never happened. Repeat DUI’s… it does not matter how nice of a person you are, the DA has a duty to protect the public from repeat offenders. Too many “guilty” individuals get off Scott Free by paying a defense attorney to manipulate reality, have sudden amnesia about what really transpired, change their story several times and the person who caused the death of another innocent person walk. The family of the loved one is forever broken. Try celebrating Mother’s day tomorrow when your loved one was taken from you by an irresponsible person who walks Scott Free. Try celebrating any holiday, try living each moment of pain after the permanent consequences caused by the poor choices of another.
