It was a foggy morning and Edgewater Drive was dark, except spots of light on both sides of the roadway. Arey and Nail's 2006 Dodge Stratus both were traveling west when the vehicle struck the 75-year-old from behind.

Nail initially was charged with fleeing the scene of an accident. A Madison County grand jury added the manslaughter charge after blood test analysis confirmed Nail had been drinking before the crash, said prosecutor Shauna Barnett.
