'Tragic Incident': IMPD investigates disturbance that led to fatal 6-vehicle crash

Police said there is no active threat to the community, however, they are asking for anyone with any information or surveillance footage in the area to come forward.

A deadly collision involving six vehicles occurred near the intersection of 38th Street and Windgate on Indianapolis' far east side on Friday afternoon, resulting in one fatality and multiple injuries. The incident began just before 5 p.m. when Indianapolis Metropolitan Police Department (IMPD) officers responded to reports of a vehicular disturbance in the area. Upon arrival, officers discovered a deceased adult male near one of the involved vehicles, with a firearm found in proximity to the victim. The circumstances of the death remain under investigation, as authorities have not yet determined whether the fatality resulted from crash trauma or gunshot injuries. Five other adults involved in the crash were transported to local hospitals in stable condition. While IMPD has assured there is no ongoing threat to public safety, investigators are actively seeking witnesses and surveillance footage from the surrounding area.

Location and Infrastructure - The intersection of 38th Street and Windgate is situated in Indianapolis' far east side, a major arterial corridor connecting residential areas with commercial districts. East 38th Street serves as a primary east-west thoroughfare, experiencing heavy traffic volumes particularly during peak commuting hours. The area features multiple lanes in each direction with dedicated turn lanes, controlled by traffic signals. This section of 38th Street provides access to several retail establishments and residential complexes, making it a heavily utilized route for both local and through traffic. The width of the roadway and multiple access points can create complex traffic patterns, especially during high-volume periods.

Legal Rights and Considerations - Under Indiana Code § 34-11-2-4, individuals involved in motor vehicle accidents have two years from the date of the incident to file personal injury claims. Victims may be entitled to compensation for medical expenses, lost wages, pain and suffering, and property damage. Indiana follows a modified comparative fault system (IC § 34-51-2-6), meaning parties less than 51% at fault may recover damages, though their compensation will be reduced by their percentage of fault. When criminal activity may have contributed to an accident, victims may have additional rights through Indiana's Violent Crime Victim Compensation Fund. Insurance claims should be filed promptly, as delays could affect coverage eligibility. An experienced Indiana personal injury lawyer will handle all aspects of the legal claim.
