Hicks, 39, was riding a motorcycle northeast on Cerrillos Road at about 7:44 p.m. Sunday when he was hit from behind by an SUV driven by 23-year-old Megan Carrillos of Pecos at the intersection with Cristo’s Road, where the traffic lights were completely out, near the Kohl’s department store in south Santa Fe.

Carrillo’s attorney, Doug Couleur, filed a motion to dismiss the indictment Dec. 5, arguing that former Chief Deputy District Attorney Juan Valencia didn’t present all of the evidence in the alert letter and that the grand jury was given a false account by one of the witnesses.
