A Depew man was charged with violating Leandra’s Law after a deputy discovered him impaired by drugs while he was driving with two children in his car, the Erie County Sheriff’s reported.
A Depew man was charged with violating Leandra’s Law after a deputy discovered him impaired by drugs while he was driving with two children in his car, the Erie County Sheriff’s reported.
A deputy responded to an accident involving two vehicles on Main Street at Sandridge Road in Alden about 8:45 p.m. Wednesday. During his investigation, the driver of one of the vehicles, David Wilczak, 30, admitted he had been using heroin that day, but he refused to submit to a blood test, according to the deputy.
Wilczak had two children, ages 5 and 9, in his vehicle at the time of the accident.
He was charged with driving while under the influence of drugs, two counts of endangering the welfare of a child and violating Leandra’s Law, the state statute that adds extra penalties for driving under the influence with passengers 15 or younger in the vehicle.
