When someone is killed because of the carelessness or misconduct of another person, the surviving members of the victim's family may bring a "wrongful death" lawsuit.  Wrongful death lawsuits can also be filed against corporations and governmental agencies for their negligence. A wrongful death lawsuit may only be filed by the personal representative of the decedent's estate. This is usually a close family member, like a spouse, adult child or parent. A personal injury attorney can assist in helping the family have a personal representative appointed.

A collision with a drunk driver is usually very serious, and often fatal, because drunk drivers speed, run red lights and cross the center line resulting in high impact crashes. Those who survive must deal with injuries, long-term medical treatment, medical bills and lost wages. In wrongful death cases, spouses and children are grieving and still have to deal with the loss of income and funeral bills.

Here's what you should know:

A serious or fatal automobile accident can be a difficult and emotional ordeal for victims and their families.  At the same time, there are multiple requests and paperwork from doctors, law enforcement and insurance companies. You may be confused and overwhelmed. If you were hurt, or if a love one died in an accident, a personal injury attorney can answer questions and help with what to do next. Personal injury attorneys and their staffs are trained to help victims and their families with the task of bringing and winning accident claims.
