Crashes involving a single motorcyclist don't always mean it's the driver's fault

There is a bias out there about motorcyclists, and some unfortunately do ignore speed limits or safety requirements, much like any driver. So if you are involved in a single motorcycle crash, does this automatically mean you are the only one at fault? There are certain considerations that may apply, and there could be more to your accident than is obvious. John McCord was stopped at an intersection in Sacramento County, California on his motorcycle as a funeral procession was passing by on a cross-street. When the light turned green, he entered the intersection. A vehicle in the funeral procession, operated by Ivan Semenyuk, ran the red light, assuming he had the right-of-way in the procession, striking McCord. As a result of the accident, McCord suffered a fractured pelvis, requiring a total hip replacement, and a knee injury.  Mr. McCord decided to sue the parties involved in his accident, including Semenyuk; Wayne McMahon, the funeral escort officer controlling both the procession and the intersection; the California Funeral Escort Company and its owner, Sam Oliver; and the Lind Brothers Mortuary.  Mr. McCord and his lawyers argued that McMahon, the escort officer, was negligent in leaving the intersection before the procession had fully crossed it. He also argued that the mortuary company was negligent for only hiring a single motorcycle escort for a procession involving 50 to 75 cars over a six mile journey to the cemetary. In addition, Semenyuk was negligent for running the red light when the escorting officer was not present at the intersection. Semenyuk argued that while he did run the red light, the other defendents were responsible, since they had failed to control the intersection and the procession. The other defendents argued that the negligence was Semenyuk's alone, as he ran the red light when the escort officer was not present or in control of the intersection. In addition, the defending parties argued that the knee injury was pre-existing and that McCord would not require any future knee or hip surgeries. In the end, the jury sided with Mr. McCord and his attorneys. They awarded him $790,000, finding Semenyuk 5% liable, and McMahon and his employer 95% liable. The mortuary was not found liable.

Required to pay back your insurer for its help with your medical bills? Here's one big reason to hire a lawyer

The thought can be quite shocking to accident victims when they first learn it. "Why would someone hurt in an accident have to pay back their insurance company for covering medical bills?" Most people believe this coverage is already compensated through years of paying premiums. However, many insurance companies will seek reimbursement once they have paid medical bills. Bill Coats Law hosts a YouTube channel with a video about what to do if you are in this situation, and sometimes, a legal advocate is your best bet for arguing a fair claim when things get complicated in auto accident claims.

Do you protect this most precious asset while on the water? Probably not

Life jackets on a boat are a must for safety, but unlike riding a bike, no boater would think to don a helmet on the water. So often all that separates our brains from serious injury with a hard object is our skull. If you've been hit in the head and are experiencing symptoms of TBI, seek a doctor's help immediately. If someone is speeding and hits you, it is almost guaranteed they are at fault

Speed limits are not just recommendations, but established rules that all drivers are expected to follow while operating their vehicles on US roads. Many factors are considered by the engineers who set the limits, such as the road’s characteristics; how wide the shoulder might be, if there is one at all; road grade; and the length of a driver’s line of sight. The limits are set very carefully after an assessment of all these factors, and are meant to keep everyone safe while maintaining a healthy flow of traffic as much as possible. Speeding is against the law. However, some drivers speed, and if you are hit by a speeder, you might be facing a long, arduous recovery. If a loved one died in an accident, this could be considered a wrongful death

A wrongful death can happen in a variety of ways, from a car or truck accident to a medical procedure that goes tragically wrong. Regardless of the cause, a wrongful death is always heartbreaking, and the resulting claim takes a special kind of experience to handle effectively. When a loved one dies as the result of negligence or recklessness, family members are overwhelmed with grief, anger, and confusion as to what to do next. Often the at-fault party will deny liability and will seek to place blame elsewhere, even on the victim. The legal process can be overwhelming for family members who are mourning and trying to come to terms with what has happened. When a wrongful death happens, the legal stakes are higher and more challenging, the at-fault parties fight harder, and the process can be stressful for surviving family members.
