A fiery two-car crash just outside of Montgomery Thursday evening has claimed a life, according to the Alabama Law Enforcement Agency.

In a tragic incident on Thursday evening, a fatal head-on collision claimed the life of 28-year-old Joseph Miller of Montgomery, Alabama. The crash occurred at approximately 6:50 PM on Alabama Highway 126, a service road running parallel to Interstate 85, approximately two miles outside Montgomery's city limits near Chantilly Parkway. According to Alabama State Troopers, Miller's vehicle collided head-on with a small SUV driven by 20-year-old Matthew Neely of Todd, North Carolina. Emergency responders arrived at the scene, where Miller was pronounced deceased. The current condition of Neely has not been disclosed in initial reports. State Troopers are actively investigating the circumstances that led to this devastating collision.

Location and Infrastructure

Alabama Highway 126, also known as the I-85 service road, serves as a crucial parallel route to Interstate 85 extending eastward from Chantilly Parkway. This two-lane highway provides local access to businesses and residential areas while accommodating traffic avoiding the interstate. The section where the accident occurred lies in a transitional zone between Montgomery's urban environment and rural Pike Road, experiencing a mix of local and pass-through traffic. The road's proximity to Chantilly Parkway, a major commercial hub, means it regularly sees both commuter and commercial vehicle traffic, particularly during evening rush hours when this incident occurred.

Legal Rights and Considerations

Under Alabama Code § 6-2-38, survivors and affected parties have two years from the date of the accident to file a civil action for damages. Alabama follows a "contributory negligence" system, which can significantly impact compensation in accident cases. Potential claims may include wrongful death benefits, medical expenses, property damage, and other compensatory damages depending on the circumstances. Insurance considerations typically involve both parties' carriers, with Alabama requiring minimum liability coverage of $25,000 per person and $50,000 per accident. Early documentation and preservation of evidence are crucial for protecting legal rights, as is prompt notification to insurance providers.
