Jeffrey Smith, 61, died when ejected from their motorcycle in a collison with a van on South River Street in Batavia, Illinois

Police say it happened in the 400 block of South River Street. 38-year-old Luis Aca-Osorio of North Aurora is charged with DUI and reckless homicide. The Batavia Police Department alleged that Aca-Osorio hit Smith's motorcycle from behind. Smith was thrown from the motorcycle and became pinned under the van.
