IMPD: Chase leads to fatal crash in Johnson County

On Thursday, officials with the Johnson County Coroner’s Office identified the person who died as 30-year-old Marco Antonio Pena Morales, a Chicago resident.

A police pursuit that began in Indianapolis Wednesday evening ended tragically on Interstate 65 in Johnson County when the fleeing suspect's vehicle left the roadway and caught fire following a high-speed crash. The incident unfolded just after 9 p.m. on Wednesday, October 1, 2025, when an Indianapolis Metropolitan Police Department homicide detective spotted a known aggravated assault suspect driving a truck near the intersection of East 21st Street and North Emerson Avenue in Indianapolis. After requesting backup, marked IMPD units attempted to initiate a traffic stop, which developed into an extended vehicle pursuit that continued onto I-65 northbound. During the chase, officers attempted a precision immobilization technique (PIT maneuver) on the suspect's truck, but the driver maneuvered out of the spin and continued fleeing. Shortly afterward, the truck left the roadway, struck a concrete culvert, went airborne, and landed in a ditch where it ignited. The driver, 30-year-old Marco Antonio Pena Morales of Chicago, was the sole occupant and was pronounced dead at the scene. No other vehicles were involved in the collision. The crash resulted in multiple lane closures on I-65 northbound that lasted until approximately 4:30 a.m. Thursday morning.

Location and Infrastructure

Interstate 65 is a major north-south thoroughfare that connects Indianapolis to Louisville, Kentucky, to the south and Chicago to the north, carrying significant commercial and commuter traffic daily through Johnson County. The stretch of I-65 northbound where this incident occurred runs through a mix of suburban and rural areas south of Indianapolis, with varying terrain that includes ditches, culverts, and other roadside infrastructure designed for drainage. This particular section of interstate typically experiences heavy traffic volumes during peak hours and serves as a critical corridor for transportation in central Indiana. The concrete culvert that the vehicle struck represents standard highway drainage infrastructure along this route. Johnson County borders Marion County (where Indianapolis is located) to the south, and I-65 serves as a primary route for travel between these jurisdictions, making it a common location for pursuits that begin in the Indianapolis metropolitan area.

Legal Rights and Considerations

Under Indiana law, police pursuits are governed by departmental policies that balance public safety with law enforcement objectives, and agencies must document adherence to these protocols during internal investigations. When fatal crashes occur during police pursuits, multiple legal considerations come into play, including potential civil liability claims, which are subject to Indiana's governmental tort immunity provisions and specific exceptions. Indiana Code 34-13-3 outlines the circumstances under which governmental entities and their employees may be held liable for injuries or damages. Families of individuals killed in vehicle crashes may have wrongful death claims under Indiana Code 34-23-1, which must typically be filed within two years of the date of death. These cases can involve complex questions about causation, the reasonableness of police actions, and the decedent's own conduct. Potential compensation in fatal crash cases may include funeral and burial expenses, loss of earnings and benefits, loss of love and companionship, and medical expenses incurred before death. Any investigation into police conduct and pursuit policies would be handled through internal affairs processes and potentially external oversight mechanisms.
