Attorney William D. Rotts filed a wrongful death petition Monday on behalf of David Birkenbach's two sisters, Jane Birkenbach and Linda Hallenberger, and his brother, Jimmy S. Birkenbach, in the Circuit Court of Boone County, one week after the incident, according to court documents.
