Troopers said Poston and Moore had been drinking at the Lowber Firemen's Club. Moore reportedly had drank too much and was falling asleep at the bar, so bartender Misty Pollock told troopers she stopped serving him alcohol. Pollock reported Poston offered to give Moore a ride home so he wouldn't have to walk, police said. Troopers said Pollock became their star witness in the case. According to investigators, Pollock said Poston drank five beers and two shots of tequila. She told police she sent Poston a text message, warning him to be careful driving since the roads were icy and he had been drinking. Police said Pollock told them that around 2 a.m., Poston sent her a text message stating he had wrecked his truck on a guard rail driving Moore to his house.
