Lee Samprath was crossing at Lanai Avenue, just east of Highway 101, about 12:30 a.m. that morning when he was hit, San Jose police said.

Samprath was declared dead at the scene of the crash. The driver who hit him stayed at the scene and cooperated with investigators, and neither drugs nor alcohol appear to be factors in the crash.
