Legal Rights and Considerations

Under Georgia law, families of individuals killed in motor vehicle accidents may have the right to pursue wrongful death claims within two years of the date of death. Georgia follows a modified comparative negligence system, where parties less than 50% at fault may seek compensation. Potential damages can include medical expenses, funeral costs, lost wages, and loss of companionship. Insurance considerations typically involve both liability coverage and potentially uninsured/underinsured motorist protection. Victims' families may be entitled to compensation from multiple sources, including personal injury protection (PIP) coverage and health insurance. Early preservation of evidence and documentation can be crucial for any future legal proceedings. An experienced Atlanta personal injury lawyer will handle all aspects of the legal claim.
