Erie County sheriff’s deputies charged Fachko with driving while intoxicated after he refused a blood test at the hospital to determine his blood-alcohol reading.

Andrew M. Mrzygut remained in critical condition at Erie County Medical Center tonight. Mrzygut was on Whitehaven Road when his car was struck from behind just after midnight by a car driven by Nicholas A. Fachko, 25, also of Grand Island. Both men were taken to ECMC by ambulance but Fachko was treated,released, and charged.
