Police ID victim in Johnson County fatal crash.

Johnson County police have identified the victim in a Wednesday afternoon fatal crash as Brian Poe, 38, Trafalgar.

Poe was a passenger in a white 1998 Dodge pickup truck driven by Devin Fleener, 18, the Johnson County Sheriff said.

The single-vehicle crash happened at about 2:07 p.m. on County Road 300 South, near the Fairhaven Christian Church, Cox said in a release. Police found the truck upside down when they responded to a report of an accident, he said.

Fleener was alert and talking, police said, but Poe was pronounced dead at the scene. He was thrown from the truck during the accident, police said.

The survivor first told police that the Poe was driving the vehicle, police said, but later admitted to being the driver. Blood tests on Fleener were pending. A portable breath test showed a blood-alcohol level of .039, according to a police report. That is less than the .08 at which a driver is considered impaired under the law, but police arrested Fleener on a preliminary charge of being a minor in possession of alcohol, Cox said.

“Alcohol and drug tests will also be performed on the deceased,” police said.

Alcoholic-beverage containers were found near the truck, police said.

After admitting he was the driver, Fleener told police Poe was “extremely intoxicated” at the time of the crash, police said.
